Effective September 14, 2020 all yard sales within the city limits of Auburn must be permitted. Please complete the information below to submit your application.
Please read the following carefully prior to submitting your application.
PERMIT REQUIRED; DISPLAY (A) No yard sale may be conducted within the city without a permit having been first issued by the City Clerk’s office at no charge. The permit shall set forth and restrict the dates and location of the yard sale. (B) Permits to be obtained during normal business hours prior to the sale date. (C) The permit required by section (A) shall be prominently displayed at the yard sale.
FREQUENCY OF YARD SALES No more than five (5) yard sale permits may be issued for any one address or resident or combination thereof during any calendar year, and no more than one (1) per calendar month. If multiple permits are issued to the same person at a different residence, or vice versa, the number of permits shall be counted collectively.
HOURS OF OPERATION Yard sales shall be limited in time to no more than the daylight hours of four consecutive days.
DISPLAY OF GOODS OFFERED FOR SALE Goods offered for sale or sold shall be displayed only on the property of the residence where a yard sale permit has been issued. Any unsold items shall be removed from public view at the end of daylight hours of the last day listed on the Yard Sale Permit.
GENERAL RETAIL SALES PROHIBITED (A) The conduct of general retail sales or commercial activities in residential areas is prohibited. (B) Yard sales must be conducted at the permit holder’s primary residence except as provided in (C) below. (C) Non-resident owners of commercial properties or vacant lots located within the city limits may allow multiple yard sale set-ups only during multi-jurisdictional yard sale events and shall be responsible for obtaining a single permit for each parcel of property owned.
STREETS AND SIDEWALKS TO BE UNOBSTRUCTED All sidewalks or walk areas abutting on or in front of the property at which any yard sale is being conducted shall remain free and uncongested so as to allow normal passage of traffic, both pedestrian and motor vehicle.
ADVERTISEMENTS All advertisements for yard sales shall be taken down and removed within 24 hours from the end of the sale.
INSPECTION AND RIGHT OF ENTRY Police officers, code enforcement officers or city administrators shall have the right to enter and inspect the premises of a yard sale during daylight hours on the date(s) of the sale as listed on the permit.
REVOCATION OF PERMIT A yard sale permit can be revoked or denied if it is determined that the applicant has submitted false information in the permit application, if the conduct of the sale is creating a nuisance or hazard, or if unlawful activity is occurring on the premises.
